Buy Insulation Online | Chase Insulations Ltd  - Quotation And Order Terms 

This document is a copy of the document you will recieve in case or an Order, Quotation or Proforma.  It must be read alongside the quotation, pro forma invoice or order details provided to you by email.

Please take a moment to ensure that the order details in the accompanying email, quotation, pro forma invoice and any attached documents are correct. If there is any discrepancy, the customer must notify Buy Insulation Online immediately in writing. If no discrepancy is raised promptly, Buy Insulation Online will be entitled to treat the customer as having received, read and accepted the order details as stated, subject always to any mandatory rights that cannot lawfully be excluded.

All orders are accepted subject to our Business (B2B) Terms and Conditions of Sale, a copy of which is attached to the email accompanying this document and is also available at www.buyinsulationonline.co.uk/terms-and-conditions.

By making payment, confirming acceptance of the order, or allowing Buy Insulation Online to proceed with supply, procurement, manufacture, import or dispatch, the customer confrms that it has read, understood and agreed to these terms.

1. Contract Basis
This order is accepted on the basis that the purchaser is acting in the course of business (a business customer). Buy Insulation Online' s Business (B2B) Terms and Conditions of Sale apply in full. Where there is any inconsistency between this Order Confirma and any purchase order or terms submitted by the customer, Buy Insulation Online' s terms prevail.
If you believe you are purchasing as a consumer (wholly outside the course of any trade, business, craft or profession), you must notify us immediately before the order is processed, as different terms will apply.

2.  Special Conditions – Imported, Special-Order and Bespoke Goods

The following conditions apply to all orders that include imported, special- order, bespoke, made- to- order, cut- to- size or manufacturer- committed items. Where an order includes such items, this will usually have been stated on the quotation or pro forma issued to the customer.

Non- Cancellable and Non-Returnable
Once Buy Insulation Online has committed the order to the supplier or manufacturer, including the payment of any deposit or production instruction, the order is final. These goods cannot be cancelled, returned or refunded except in cases of proven manufacturing defect or where a mandatory statutory right applies that cannot lawfully be excluded.

Lead Times
Any lead time or delivery date provided is an estimate only. Due to  fluctuating manufacturer availability, stock allocation, transport capacity, customs clearance, port handling and other supply- chain pressures, deliveries may take longer than originally indicated and lead times may be extended while stock is awaited or becomes available. Time is not of the essence for delivery unless expressly con rmed in writing by a director of Buy Insulation Online.

Price
Prices are confirmed at the time of acceptance. If an exceptional and unforeseen change in manufacturer pricing, freight costs, import duties or currency exchange rates occurs after order acceptance but before the factory or supplier order is committed, Buy Insulation Online will notify the customer and seek written approval before proceeding.

3.  Delivery

Kerbside Delivery
Unless otherwise agreed in writing, all deliveries are made to the kerbside of the delivery address. The customer is responsible for arranging suitable unloading equipment and labour. Buy Insulation Online accepts no liability for any cost, delay or damage arising from the customer' s failure to make adequate unloading provision.

Access
The customer must ensure safe and suitable vehicular access for delivery and must provide any relevant site restrictions, access requirements or delivery constraints in good time. Where access is unavailable, unsuitable, or materially different from that originally advised, additional delivery, abortive, storage, redelivery or associated charges may apply.

Split Deliveries
Buy Insulation Online reserves the right to make split deliveries where necessary, particularly for large, special- order or imported orders. Each delivery may be subject to a separate proof of delivery.

Risk
Risk in the goods passes to the customer on delivery. Title passes only when all sums due to Buy Insulation Online have been received in cleared funds.

4. Inspection, Shortages and Damage

Inspect on Delivery
The customer must inspect all goods at the point of delivery, wherever reasonably practicable, before the delivery vehicle departs. Any visible shortages, missing parcels or transit damage must be noted clearly on the carrier' s Proof of Delivery (POD) document at the time of delivery.
 
Reporting – Shortages
Any shortage or missing items must be reported to Buy Insulation Online in writing by email to [email protected] within 24 hours of delivery. The report must include the order reference, details of the shortage and supporting photographs where possible.

Reporting – Transit Damage
Any visible transit damage must be reported to Buy Insulation Online in writing by email to [email protected] within 48 hours of delivery. The report must include the order reference, photographs of the damaged goods and packaging together, and a copy or photograph of the annotated POD.

Late Claims
Claims made outside these reporting windows cannot be accepted, except where a latent manufacturing defect could not reasonably have been discovered at the time of delivery. Signing the POD unchecked does not extend these windows.

Proof of Delivery
Proof of delivery may consist of a handwritten signature, veri ed electronic signature, driver photographs at the delivery address, GPS or geolocation data with timestamp, scanned delivery notes or driver logs. Where leave- safe delivery has been requested or delivery made without a signature, photographic and/or GPS evidence will constitute valid proof of delivery subject to any written challenge made within the applicable reporting windows above.

5.    Returns and Cancellations
Returns and cancellations are governed by Buy Insulation Online' s Business (B2B) Terms and Conditions of Sale and by the special conditions in Section 2 above.

In summary:

• Standard stocked goods may be returned by prior written agreement only and may be subject to a restocking charge.
• Special- order, imported, bespoke, cut- to- size and made- to- order goods are non- returnable and non- cancellable once committed to the supplier or manufacturer, except for proven manufacturing defects.
• Goods must not be returned without prior written authorisation. Unauthorised returns will not be accepted.
• Original delivery charges are non-refundable.

6.    Limitation of Liability
Except where liability cannot lawfully be excluded, including for death, personal injury caused by negligence, or fraud, Buy Insulation Online' s liability is limited to the invoice value of the goods or services in question. Buy Insulation Online shall not be liable for any loss of pro t, revenue, business, project cost, contract, anticipated saving or any other indirect or consequential loss arising from or in connection with any order.
 
7.    Governing Law
This contract is governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales.
